the use of external links:
According to § 5 art. 1 Medien-dienste-Staatsvertrag, DSC GmbH, as a content-provider,
is responsible for the offered content, which it provides
for public usage according to the prevailing law. Cross
references ('links') to content offered by other providers
are to be distiguished from this proprietary content.
Through cross references DSC renders 'non-proprietary
content'. For this non-proprietary content DSC is only
responsible if DSC had positive knowledge of it (i.
e. including knowledge of illegal and criminal content)
and DSC had the technical capability and could be reasonably
expected to prevent the use of it (§ 5 art. 2 Mediendienste
Staatsververtrag).

DSC GmbH did initially (when the link was first established)
examine the non-proprietary content to assess its criminal
or illegal potential according to civil and criminal
law. DSC GmbH however is not obligated to continually
review , the contents which it cross references on its
site, for an indication of new legal responsibility
caused by changes to the referenced sites.
Only if DSC GmbH observes or is advised by others, that
a certain offer to which it has establisehd a link,
will justify a persecution according to civil or criminal
law, will it offset the reference to this offer, insofar
as it is reasonable and it has the technical capability.
The technical capability and reasonableness is not influenced
by the fact that access to the criminal or illegal offer
will still be possible from other servers, after access
is denied from DSC GmbH’s website.
